These Terms and Conditions govern your use of found-fashion.com and any purchase you make through it. By accessing or placing an order on this website, you agree to be bound by these Terms. If you do not agree, please do not use this website.
This website is operated by Found Collective Group Limited ("we", "us", "our"). References to "you" or "the customer" mean the individual accessing the Site.
1. AUTHENTICITY
All items listed on our website are 100% authentic. Receipts and invoices can be provided on request at the time of purchase. Found Collective Group Limited is not associated with, affiliated with, or endorsed by any of the brands whose items are listed on the Site.
2. USE OF THE WEBSITE
found-fashion.com is an online retail service provided for your personal use for the sale of clothing, footwear, accessories and other items.
We have taken care to present items as accurately as possible. However, colour accuracy depends on your monitor settings and we cannot guarantee exact colour reproduction. Please read these Terms carefully before placing an order.
We reserve the right to amend or withdraw the Site or any content at any time without notice.
3. ELIGIBILITY TO PURCHASE
To make purchases on the Site you must:
- Be at least 18 years of age
- Provide accurate personal details including your real name, phone number, email address, and billing information
- Be the authorised holder of the payment method used
By placing an order, you confirm that all information provided is accurate and complete.
4. MAKING A PURCHASE
When you place an order, you are making an offer to purchase at the stated price, subject to these Terms.
Once your order is placed, we will send an acknowledgement email confirming the details. This is not an acceptance of your order.
A binding contract between you and us is formed only when we send a dispatch confirmation email. The contract is deemed complete at the time and date that email is sent, regardless of whether you receive it.
We reserve the right to decline any order at our sole discretion. Reasons may include: the item cannot be sourced, a pricing or product error has been identified, or a fraudulent purchase is suspected. If we are unable to fulfil your order after acknowledgement, we will notify you promptly.
We cannot guarantee that any item will remain available at the time of ordering.
5. PAYMENT
We accept payment via credit card, debit card, and other payment methods displayed at checkout.
All transactions are subject to validation and authorisation by the card issuer. If your payment is declined or subsequently reversed, we accept no liability for any delay or non-delivery.
Payment is taken at the point of dispatch. Prior to this, an authorisation hold may appear on your bank statement reserving the funds. If your order is cancelled, we will request release of the authorisation immediately. If the hold persists after several days, please contact your bank directly.
6. RETURNS & CANCELLATIONS
Pre-existing inventory items
If you purchase an item from our existing inventory, you have the right to cancel your order within 14 days of receiving the item under the Consumer Contracts Regulations 2013. To cancel, please email contact@found-fashion.com within this period. Items must be returned in the same condition as received, unworn and with all original packaging. Return shipping costs are the responsibility of the customer unless the item is faulty or misdescribed.
Sourced and bespoke items
Where an item has been sourced specifically to your request, this constitutes a bespoke order and is exempt from the standard 14-day cancellation right under the Consumer Contracts Regulations 2013. Once sourcing has commenced, you may not be able to cancel and may remain liable for all or part of the agreed fees. We will confirm this clearly before sourcing begins.
Wrong item received
If you receive an incorrect item, please email contact@found-fashion.com within 24 hours of delivery with your order details and a photograph. We will arrange a replacement or full refund at no cost to you.
Order cannot be fulfilled
In the rare circumstance that your order cannot be sourced or fulfilled, we will offer an alternative or a full refund.
All items are thoroughly inspected before dispatch to ensure they meet our condition standards.
7. DISCOUNT CODES
Discount codes may be issued via email, WhatsApp, social media or promotional materials. The following conditions apply:
- Free shipping codes apply to the standard delivery option only. Taxes, duties and customs fees remain chargeable
- Codes are personal to the recipient, non-transferable, have no monetary value and cannot be converted to cash
- Each code carries an expiry date as stated at the time of issue
- Only one discount code may be applied per order
8. SOURCING SERVICES
Sourcing requests can be submitted via our contact page or directly through our team.
Your request is accepted when we confirm in writing (by email or WhatsApp) or verbally by telephone. The contract for sourcing services is formed by our exchange of correspondence, any confirmations or invoices we issue, and these Terms.
We will advise you of any applicable fees before commencing work. We reserve the right to decline any sourcing request at our sole discretion. As sourced items are procured specifically to order, once sourcing has begun it may not be possible to cancel and fees may still be payable in full or in part.
9. INTELLECTUAL PROPERTY
All content on this Site, including text, images, logos, and design, is owned by or licensed to Found Collective Group Limited. Nothing on this Site grants you any rights in relation to copyright, trademarks, or other intellectual property.
You may not reproduce, redistribute, or publish any content from this Site without our prior written permission. Civil and criminal penalties may apply for unauthorised use. You may make one copy of content for personal viewing purposes only.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Found Collective Group Limited shall not be liable for:
- Any indirect, incidental, or consequential loss arising from your use of the Site
- Loss of profit, revenue, data, or business opportunity
- Any inaccuracy in product descriptions or pricing caused by typographical error
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Our total liability to you in connection with any order shall not exceed the amount paid by you for that order.
11. PRIVACY
Our collection and use of your Personal Information is governed by our Privacy Policy, available at found-fashion.com/policies/privacy-policy. By using the Site, you agree to the terms of our Privacy Policy.
12. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of Hong Kong SAR. Any disputes arising from these Terms or your use of the Site shall be subject to the non-exclusive jurisdiction of the Hong Kong courts.
If you are a consumer resident in the United Kingdom or European Union, nothing in this clause affects your statutory rights under the laws of your country of residence, which cannot be excluded or limited by contract.
13. CHANGES TO THESE TERMS
We may update these Terms from time to time. The current version will always be available on the Site. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.
